Case Committee 2019
Each year's FDI Moot Case Committee is selected in May of the preceding year (applications for the 2020 case committee by 1 March 2019) and begins its work in June. Liaising with the FDI Moot's Board and Directors, the Committee develops a factual and procedural context and the issues to be argued in the competition. It submits a concept by July, a first draft by August (review committees of academics and practitioners) and its second draft by November, with the case being finalised for board approval by January, and the case is then published in February. The Case Committee remains responsible for responding to requests for clarification in June and August.
Generally, the case evolves on the basis that the home and host State are parties to an IIA. The 2019 case involves the respondent State’s blocking of social media platforms on the basis of their alleged part in fomenting unrest in an already tense environment. The three claimants allege expropriation and violation of fair and equitable treatment, while the Respondent objects to the ICSID tribunal’s jurisdiction on the basis of its denunciation of the ICSID Convention and the plurality of claimants. The Respondent also seeks to enjoin the Claimants international media campaign against the it while the proceedings are in progress.
The 2019 Case will be published in early February.
